Competitors react to Steve Jobs’ resignation

Yesterday’s news that Steve Jobs decided to stand down as the CEO of Apple wasn’t entirely shocking to seasoned Apple watchers who knew this day would come. The writing has been on the wall for quite some time, if you were willing to read early signs, such as an open-ended sick leave nearly stretching into its ninth month. Wall Street understandably sent AAPL down 4.6 percent to $358.75 in early New York trading in what one investor described as “an emotional trade in the short term” that also affected Nasdaq-100 Index and Standard & Poor’s 500 Index which both declined a fraction of a percent on the news. Meanwhile, companies Apple counts as competitors gained. Both shares of Samsung and LG Electronics, which compete fiercely with Apple on smartphones, gained 2.4 percent and 1.3 percent, respectively, in Seoul trading.

NH Investment & Securities Co. analyst Seo Won Seok says Cook, Apple’s newly appointed CEO, “may try to improve the relationship with Samsung” or even work out a settlement of sorts. The notion has its merits as Steve Jobs was a strong advocate of intellectual property protection as Apple banned the copyist Samsung from selling smartphones and tablets in Australia, the European Union and elsewhere. Jobs exit could also turn into “lease of life” for Sony, Nokia, Hewlett-Packard, HTC and ZTE Corp – all companies under tremendous competitive pressure stemming from Apple’s successes in multiple markets. While Samsung and HTC spokespersons wouldn’t come on the news, top dogs from Sony, Nokia and ZTE would. Here’s how they complimented Jobs’ achievements…

First Sears now Sony?

Reader Elaine sends us this scene from a Costco

So I imagine there is a marketing meeting at the Sony Bravia offices a few months ago where they are brainstorming new ways to market this 46″ TV.

Someone steps up and says Apple is about to release a new OS and all of their boxes are going to have this ‘Galaxy Swirl’ thing on the cover. Perhaps we can confuse a few people into thinking this is Apple/type/quality products.

Sure, its a different angle and view, but it is pretty clear what the intention was. While this is probably legal and will certainly fool a certain part of the population, those who follow tech have to feel a little sorry for the once-great Sony, which is rapidly turning into an also-ran knock-off artist.

*thanks 9to5mac*

Sears had an iWork toolset a while back. It seems everyone is trying to make a buck off apple customers...

Forbes: Apple is fifth most innovative company, Google is #7 Don’t even ask about Microsoft.

Forbes has put together (via setteB.IT) a list of the World’s Most Innovative Companies and Apple ranked fifth. Salesforce.com leads the pack, followed by Amazon (#2), Intuitive Surgical (#3) and Tencent Holdings (#4). Interestingly, Google is seventh most-innovative company in the world on the publication’s list. Other worthy mentions: Nintendo (#20), Activision Blizzard (#22), Starbucks (#19), PepsiCo (#50). The usual suspects don’t fare well, however. Adobe is ranked 54th (little wonder, with their confused CEO) and Apple’s court friend HTC is 56th. Steve Jobs best friend’s company Oracle is 77th and Microsoft is far down on the list, ranked 86th. The full list is available here. But wait, how do you measure innovation? Read on…

Forbes calls it the five skills of disruptive innovators and here they are:

Questioning allows innovators to challenge the status quo and consider new possibilities; Observing helps innovators detect small details—in the activities of customers, suppliers and other companies—that suggest new ways of doing things Networking permits innovators to gain radically different perspectives from individuals with diverse backgrounds; Experimenting prompts innovators to relentlessly try out new experiences, take things apart and test new ideas; Associational thinking—drawing connections among questions, problems or ideas from unrelated fields—is triggered by questioning, observing, networking and experimenting and is the catalyst for creative ideas.
That, and the usual stuff to consider such as sales, profitability, growth, market share, hype and other tangibles and intangibles.

comScore: iPhone continues to gain ground even without a refresh

While Google passed the 40% smartphone share (Microsoft must be happy!) in the US threshold, Apple continues to outpace the industry as a whole posting modest 1 point gains in the US smartphone category according to comScore. Apple moved up from 25.5% in March to 26.6% in June on the year old iPhone 4 model which also saw its US debut on Verizon.

Apple also moved up in the hardware category, below:

Apple outpaces Samsung and LG for the quarter at the expense of Motorola and RIM. No shocker there.

iPhone captured two-thirds of mobile phone profits in the second quarter

Global operating profit from the sale of mobile phones among eight major players, by Asymco

In case you missed it, the big news today is that Apple is king of the hill in smartphones and is now chasing LG for the third place in global cell phone sales. Samsung, which reported its second-quarter earnings today, ranks as the world’s second-largest smartphone maker in units, but the company said it will cease reporting phone and tablet sales citing competition from Apple. If that didn’t impress you, this data point will blow your mind: More than six out of ten dollars of profit in the mobile phone business go to Apple’s pockets, or 66.3 percent. This is interesting because it shows Apple steadily improving its profitability in the cell phone space at the expense of its rivals, Asmyco’s Horace Dediu explains:

This share is up from 57% in Q1 and 50% in Q3 and Q4. Samsung’s share went to 15%, though that’s not a peak level historically. In Q1 2008 the company was at 21%. RIM was at 11%, a level in a range that has been unchanged for three years. Finally, HTC captured 7.4%, a new high and an increase from 6% since last quarter.
And guess who controlled the industry’s profits four years ago, when the iPhone debuted? That’s right, Nokia, which in the second quarter of 2007 enjoyed 55 percent of global operating profit from the sale of mobile phones. Back then, Apple, Research In Motion and HTC collectively captured 11 percent of the profits and now they together control 84 percent of the profits. And another somewhat related tidbit: Apple now has more cash than the world’s largest sovereign government.

Apple Created the Rockstar Group After They Dropped Out of Nortel Auction

A consortium of companies including Apple won the auction for Nortel's patents; however, Apple originally went into the auction alone. Only after Rockstar Bidco (RIM, EMC, Ericsson, Sony, Microsoft) dropped out of the bidding did Apple form a partnership to stake the group, according to TechCrunch.

By the fifth round of bidding, it was Rockstar Bidco that decided not to submit a bid. This brought the group of bidders down to three: Google, Apple, and Intel. Then something really interesting happened.

Following Rockstar's seeming exit, Apple asked Nortel for permission to talk to the group about a possible partnership. This request was granted. Following these discussions, Apple decided they wanted to partner with Rockstar and adopt their name and transaction structure. Essentially, Apple decided to stake the Rockstar group in this high-stakes poker game.

Eventually, Intel dropped out and partnered with Google; however, in the 19th round Apple's group was able to win with a bid of $4.5 billion.

Sony PS3 Jailbreak Hacker Bankrupted, May End Up in Jail

Although Geohot was able to settle with Sony over the PS3 jailbreak, other hackers have not fared as well.

Graf_chokolo is a hacker who worked hard to bring linux back after Sony removed the install option from the PS3. He has run out of money to fight Sony's lawyers and may end up in jail as a result.

Hi guys, no money left anymore. Going to jail soon probably because i cannot pay court costs.

But i’m ready to stand up for everything i said and go to jail for that too. It’s not important to win, more important is to show them that we are ready to fight, that they cannot scare me off easily. Yeah, i’m ready to go to jail for my believes and my principles.

Most of people probably think that all computer and kernel hackers are weak kids, hiding in a cellar, eating pizza whole day, writing software and looking for attention :-) Maybe, but that’s NOT me. And i will get out eventually and continue my work. My work means very much to me.

Those looking to contribute to Graf's defense can do so here.

Inspired by iPad and the Air, Intel talks up Ultrabooks and Android-friendly tablet chips

Forget about Chromebooks, here come the Ultrabooks. Ultra-what? Per Intel’s presser at the Computex show in Taipei, Taiwan, Ultrabooks represent an entirely new class of notebooks that include the best features of tablets. If this sounds suspiciously familiar, look no further than the upcoming Mac OS X Lion operating system that is being pitched by Apple as “taking our best thinking from iPad and bringing it all to the Mac” or the MacBook Air’s iPad-like instant-on promise. Intel is playing exactly the same iPad card, their senior vice president Tom Kilroy telling Reuters:

We’re shooting for ultra responsive. You’ll have always-on, always-connected, much more responsive devices, similar to what you would see with a tablet today such as an iPad.
This sounds a lot like a catch-up to the MacBook Air’s all-flash instantaneous performance, cynics would argue. Ultrabooks are about Intel’s latest chips and reference designs. Intel also took the wraps off of its new fanless netbook platform code-named “Cedar Trail” and proposed a “Medfield” tablet reference design for sub-9mm designs, weighing less than 1.5 pounds and supporting a choice of operating system, per press release. So when can we expect first Ultrabooks to challenge MacBook Air’s dominance?

Intel says first Ultrabooks will be available in time for the holiday shopping season, priced in the sub-$1000 range and eventually settling at around $600 within a couple of years. Intel has high hopes for these machines, telling the news gathering organization that Ultrabooks should account for 40 percent of all consumer notebook sales by the end of 2012. Intel has been attempting to make a dent in mobile for years. The company’s latest moves in this space include the Oak Trail processor, their first designed specifically for tablets, and the new tri-gate transistor technology that crams more transistors onto chips, making them speedier yet at the same time power efficient.

Another part to this strategy is the Ivy Bridge platform. Billed as a Sandy Bridge successor, Ivy Bridge will improve graphics performance and power efficiency while enabling better responsiveness and stronger security. First Ivy Bridge chips fabbed on the new 22-nanometer tri-gate transistor technology are expected by April 2012. Intel will also launch “Haswell” processors in 2013, said to cut power requirements to half of today’s chips. Meanwhile, ViewSonic showed off a tablet yesterday engineered around the new Oak Trail chip. Acer is also expected to come out with an Android tablet with an Oak Trail chip inside and yesterday they showed off the ultra-thin UX2 notebook, depicted in the video below. A number of companies have been trying to replicate Apple’s engineering solutions with the MacBook Air, from Samsung’s Series 9 to Dell’s thin notebook.

Sony’s Crackle bug leaves location services on in iOS

Crackle’s “It’s On!” moniker could refer to Location Services which the application asks to turn on the first start up. The problem is that Crackle, even when closed, leaves Location Services on, which could drain the battery. Users have to go into Setting/Location Services to deny it access manually (below).

We’re waiting for that bug to be squashed and also an Airplay option in an upcoming update (but otherwise it is a pretty solid way to get Sony content).
*thanks 9to5Mac*

Airplay would be a great feature for this app. Netflix watch out Crackle is taken over!

Sony to release Crackle iOS App, free access to tons of TV shows and movies

iPhone, iPod touch and iPad owners will soon have access to Sony’s growing library of free movies and TV shows on Crackle.com. We just saw the news when browsing to the service on our iPad.

Crackle is a growing collection of Sony’s library of TV shows and movies including some recent hits and well as B-listers. The content is monetized with ads just like Hulu. Currently, the service is only available via Flash.

SCEA vs. Geohot: Sony wins a not-quite flawless victory

Well, after all the talk of TROs, tweets, and YouTube user info, it seems that the SCEA vs. Geohot litigation has come to a rather uneventful conclusion. According to Sony's Playstation Blog, the case has been settled, and Hotz has agreed to a permanent injunction preventing him from distributing his PS3 jailbreak hack ever again. Of course, while this settlement has cowed the man who did the initial distribution deed, the jailbreak genie's out of the bottle, and no court order can ever put it back.

Judge Gives Sony Access to Geohot's Paypal Account

Magistrate Joseph Spero has ruled that Sony may subpoena Geohot's Paypal account to obtain the information of anyone who donated to him.

This is the latest in a series of questionable rulings in which Spero has allowed Sony to access Geohot's hosting, YouTube, and Twitter accounts in their quest to prosecute Geohot for jailbreaking the PS3.

Wired notes that "The latest development allows the Japanese console maker to acquire 'documents sufficientto identify the source of funds (.pdf) in California that went into any PayPal account associated with geohot@gmail.com for the period of January 1, 2009, to February 1, 2011,' Spero ruled."

It's not exactly clear but we are hoping the only information Sony can obtain is the geographical location of donators. Sony is trying to sue Geohot in San Francisco rather then in his home state of New Jersey.

A judge has ordered Geohot's host to provide Sony with the IP addresses of everyone who visited Geohot.com.

Sony has also won subpoena to retrieve Geohot's Twitter history, the personal information of anyone who visited or commented on Geohot's blog and anyone who access Geohot's private video on YouTube.

Sony is suing Geohot for jailbreaking the PS3 in a case which will set precedence for customer rights in the future.

a. The Bluehost Subpoena
This subpoena to Bluehost, the content server for Mr. Hotz's website at , seeks the identity of those who have downloaded the circumvention devices from Mr. Hotz's website. SCEA has a good faith basis to obtain this information because it is relevant to whether the Court has jurisdiction over Mr. Hotz. SCEA needs to determine how rampant the access to and use of these circumvention devices has been in California in order to rebut Mr. Hotz's suggestion that his illicit conduct was not aimed at the forum state. Not only is this information relevant to SCEA's opposition to the Motion to Dismiss, but it also relates to a "core claim" insofar as the trafficking provisions of the Digital Millennium Copyright Act ("DMCA") – which SCEA alleges Mr. Hotz has violated – pertain directly to evidence of a defendant's distribution of a circumvention device to other persons. Finally, the identity of those who have downloaded the circumvention devices from cannot be discovered from any entity except the site's web content host, Bluehost.

b. The Twitter Subpoena
This subpoena seeks "Tweets" published by Mr. Hotz, many of which SCEA believes relate directly to his hacking of the PS3 System.5 SCEA has a good faith basis to obtain this information because it is relevant to whether the Court has jurisdiction over Mr. Hotz. SCEA seeks to determine whether Mr. Hotz was directing any of his Tweets regarding his hacking of the PS3 System at persons residing in California, and to what extent Mr. Hotz used Twitter to discuss the hacking efforts targeted in this lawsuit. Further, as Mr. Hotz has attempted to shirk responsibility for some of these Tweets because SCEA could not produce original copies of the Tweets posted under Mr. Hotz's account, it is particularly important at this phase of jurisdictional discovery that SCEA be able to access this material. Again, not only does this information relate directly to SCEA's opposition to the Motion to Dismiss, but it relates to a "core claim" insofar as the information sought will reveal important facts about Mr. Hotz's hacking efforts. Finally, SCEA does not believe these Tweets can be discovered from any entity other than Twitter itself. Importantly, this information is not available to SCEA through any other avenue or medium.

c. The Google Blogspot Subpoena
This subpoena seeks to discover information relating to a specific Blogspot account that is owned by Mr. Hotz, , and information regarding persons who also posted content to that website in the form of blog comments. SCEA has a good faith basis to obtain this information because it is relevant to whether the Court has jurisdiction over Mr. Hotz. SCEA seeks to determine whether Mr. Hotz discussed his hacking of the PS3 System with persons in California through his blog. Again, not only does this information relate directly to SCEA's opposition to the Motion to Dismiss, but it relates to a "core claim" insofar as the information sought will reveal important facts about Mr. Hotz's hacking efforts. Finally, information regarding persons who posted content at cannot be discovered from any entity except Google.

d. The YouTube Subpoena
This subpoena seeks to discover information regarding all persons who currently have access to a "private video" uploaded by Mr. Hotz demonstrating his use of the circumvention devices on the PS3 System, and those who posted comments in response to the video. Mr. Hotz posted the video for public viewing on January 7, 2011. Since that time, the video became "private." Pursuant to the TRO entered on January 27, 2011 (and the subsequent Preliminary Injunction), Mr. Hotz is prohibited from publishing or posting any circumvention devices or instructions on how to use them, and cannot assist, facilitate or encourage others to engage in the unlawful activity enjoined by the Court. (See Docket Nos. 50 and 87). Therefore, SCEA must be able to discover what persons, if any, are still able to access the "private" video after the TRO went into effect in order to ascertain whether Mr. Hotz continues to share this "private" video regarding his hacking of the PS3 System with persons in California and determine whether Mr. Hotz has violated the TRO and Preliminary Injunction.6 SCEA has a good faith basis to obtain this information because it is relevant to whether the Court has jurisdiction over Mr. Hotz. Again, not only does this information relate directly to SCEA's opposition to Mr. Hotz's Motion to Dismiss, but it relates to a "core claim" insofar as the information sought will reveal important facts about the intent behind Mr. Hotz's hacking efforts and whether Mr. Hotz is in violation of the TRO by continuing to offer the video. Finally, information regarding persons who have access to the "private" video that Mr. Hotz uploaded cannot be discovered from any entity except YouTube.7
The EFF also challenges the YouTube subpoena under the Video Protection Privacy Act, 18 U.S.C. § 2710 ("the VPPA") and the Stored Communications Act, 18 U.S.C. § 2701 et seq. ("the SCA"). Contrary to the EFF's assertions, neither the VPPA nor the SCA prohibit the issuance of the third party subpoena to YouTube. The VPPA does not mandate a per se prohibition on disclosure of "personally identifiable information" as the EFF implies. In fact, nothing in the YouTube subpoena prevents YouTube from providing notice of this action to user, nor does the subpoena deprive users of the opportunity to "appear and contest the claim" as required under the VPPA. See 18 U.S.C. § 2710(b)(2)(F). To the extent that the VPPA requires SCEA to provide notice to users directly, SCEA is unable to do so until the subpoena issues as it does not presently know the identity of these users. Thus, the YouTube subpoena does not violate the VPPA. Nor does the YouTube subpoena violate the SCA. Nothing in the YouTube subpoena prevents YouTube from first obtaining the "lawful consent of the...subscriber..." for disclosure of information regarding persons who have access to the "private video" that Mr. Hotz uploaded on YouTube before providing such information in response to the subpoena. See 18 U.S.C. § 2702(b)(3).

Donate to Help Geohot Fight Sony

Geohot has set up a new blog and is asking for help in his legal battle with Sony.

Media, I need your help. This is the first time I have ever asked. Please, if you support this cause, help me out and spread the word.

I want, by the time this goes to trial, to have Sony facing some of the hardest hitting lawyers in the business.

Together, we can help fix the system

Sony is suing Geohot and fail0verflow for jailbreaking the PS3 console. This is a case that could have huge ramifications for consumer rights. The EFF says, "Sony's core arguments — that it can silence speech that reveals security flaws using the DMCA and that the mere fact of a terms of use somewhere gives a company permanent and total control over what you do with a device under pain of criminal punishment — are both sweeping and frightening, and not just for gamers and computer researchers. Frankly, it's not what we expect from any company that cares about its customers, and we bet it's not what those customers expect, either."

The Library of Congress Copyright Office has ruled that smartphone jailbreaking was legal but they have not as of yet made the same ruling for game consoles. Geohot has helped many in the iPhone community with his jailbreaks. We urge you to donate towards the cause. You can read more details about this on http://www.geohot.com or at his new "Geohot Got Sued" blog.

Sony Demands YouTube Reveal Personal Info From PS3 Jailbreak Video

Sony is demanding that YouTube surrender the personal information of those who viewed Geohot's PS3 jailbreak video on a private page, according to Wired.

The company is demanding that a federal judge order Google to surrender the IP addresses and other identifying information (.pdf) of those who have viewed or commented about the jailbreak video on a private YouTube page. The game maker is also demanding that Twitter provide the identities of a host of hackers who first unveiled a limited version of the hack in December. A hearing is tentatively set for Wednesday. Sony filed its documents about 7:30 p.m. PST on Friday.

In what has widely been described as an outrageous and frightening case, Sony has sued Geohot for jailbreaking the PS3. The Electronic Frontier Foundation notes that Sony claims it has rights in the computer it sells you even after you buy it, and therefore can decide whether your tinkering with that computer is legal or not. The U.S. Copyright Office has exempted cell phone jailbreaking from being covered by the DMCA; however, the PS3 and other gaming consoles have yet to be exempted.

Geohot has recently posted a Motion to Dismiss which is set for hearing on March 11th.

Apple Rejects Sony Reader Application for the iPhone and all iOS devices.

Apple has reportedly rejected the Sony Reader application for the iPhone because it allows people to buy and read e-books bought from the Sony Reader Store, according to the NYT.

Apple told Sony that from now on, all in-app purchases would have to go through Apple, said Steve Haber, president of Sony’s digital reading division.

"It's the opposite of what we wanted to bring to the market," Mr. Haber said. "We always wanted to bring the content to as many devices as possible, not one device to one store."

This rejection could also signal problems for Amazon who provides a similar application for its Kindle.

Court Grants Sony's Temporary Restraining Order Against Geohot for jailbraking the ps3

The United States District Court of California has granted Sony's request for a Temporary Restraining Order and Order of Impoundment against Geohot over the PS3 jailbreak.

Having considered all the papers and arguments, the Court finds that SCEA has shown a likelihood of success on the merits of its claims for violation of the DMCA and CFAA, and that it will suffer irreparable harm unless Defeendant Hotz's violations are enjoined. The Court also finds that a Temporary Restraining Order and Order of Impoundment are necessary to prevent immediate and irreparable injury to SCEA before the hearing on the Order to Show Cause regarding the preliminary injunction can take place, and to preserve the status quo. The Court further finds that the balance of equity and interests of justice support granting such relief.

The Electronic Frontier Foundation recently addressed the matter. "That [Sony] can silence speech that reveals security flaws using the DMCA and that the mere fact of a terms of use somewhere gives a company permanent and total control over what you do with a device under pain of criminal punishment — are both sweeping and frightening". Its more than a little concerning that the United States Court is upholding Sony's actions.

EFF Speaks Out Against Sony's Frightening Case Against Geohot

The Electronic Frontier Foundation has spoken out about Sony's 'outrageous' and 'frightening' case against Geohot.

In a lengthy post on its blog, the EFF explains dangerous implications if Sony were to succeed in its case.

That means Sony is sending another dangerous message: that it has rights in the computer it sells you even after you buy it, and therefore can decide whether your tinkering with that computer is legal or not. We disagree. Once you buy a computer, it's yours. It shouldn't be a crime for you to access your own computer, regardless of whether Sony or any other company likes what you're doing.
....
Sony's core arguments — that it can silence speech that reveals security flaws using the DMCA and that the mere fact of a terms of use somewhere gives a company permanent and total control over what you do with a device under pain of criminal punishment — are both sweeping and frightening, and not just for gamers and computer researchers. Frankly, it's not what we expect from any company that cares about its customers, and we bet it's not what those customers expect, either.
